cybersquatting

Has anyone had any experience with GoDaddy.com?

I have a domain name which appears to be owned by them, as per the whois info:

  Registered through: GoDaddy.com, LLC (http://www.godaddy.com)

  Domain Name: MYSITE.COM

On the domain in question, there is a link which reads 'interested in this domain'

I phoned 'GoDaddy.com' up to inquire about what exactly their service is regarding the 'Domain Buy Service', their response:

We basically go talk to the owner and try to negotiate a deal

But... they own the domain according to the whois, and they even advertise on the site sitting on the domain name:  'Interested in buying me, click here to go to godaddy'.

UDRP (Uniform Domain Name Dispute Resolution Policy) or ACPA (Anti-cybersquatting Consumer Protection Act) appear to protect domain names based on trademark infringements but nothing else. Furthermore they can only assist when the trademark was acquired before the registration of the domain name.

I know potentially you could argue that this sort of business is acceptable as it is similar to the landlord owning a building before the shop owner had the idea of setting up a shop.

Is there really nothing you can do except pay the organisers of the scam to get hold of the domain you want? It really feels like buying tickets from a tout outside a gig for x times more that its worth!

There is still nothing there that says they own the domain.  You need to find the part that lists the owner.  Possibly toward the bottom of the output if it is there.  Ex, for my domain:

  Domain Name: AOEEX.COM

  Registrar: GODADDY.COM, INC.

  Whois Server: whois.godaddy.com

  Referral URL: http://registrar.godaddy.com

  Name Server: NS33.DOMAINCONTROL.COM

  Name Server: NS34.DOMAINCONTROL.COM

  Status: clientDeleteProhibited

  Status: clientRenewProhibited

  Status: clientTransferProhibited

  Status: clientUpdateProhibited

  Updated Date: 02-apr-2009

  Creation Date: 24-may-2001

  Expiration Date: 24-may-2018

>>> Last update of whois database: Wed, 21 Dec 2011 22:08:15 UTC <<<

[snip lots of legal text]

Registrant:

  Keith M

  [snip address]

  United States

That bold part is what you need to find, or something similar.

Yea.. I didn't realise that "proxy, inc" was essentially a private whois.

I read up a little on it and there is some dispute in quite a lot of cases to the legitimacy of hiding the whois behind proxy, inc. Without seeing behind all the shut doors it is impossible to really see whether the domain you want is being held by a "cybersquater" or not. In my case i think it would be fair to assume that it is the case, but thn i cannot prove it.

(thanks for pointing out the tips on the whois info tho)
