it really depends on the agreement but the "Idea" can't be copyrighted

 

if you only changed a few parts of the code or memorized the whole thing then re-created it then your probably loss. but its also proving you copied it

 

if you got the code via memory peek & poke or decrypting it, then you are probably breaking the agreement

 

basically it depends on the agreement (which no one reads)

if you used the logic then check the license it may have a option to pay for use on commercial applications, you can also write to the developer and ask.. saves being sued.

 

EDIT: also try searching the web again you may find a better one. do you have a copy of the license agreement ?

as some only insist you include their name (some on the page, but some just in credits)

Seriously, if you are going to "re-create" the application in your own code, there is no violations against that. Who is to say I cannot create my own E-Commerce site and where I got my ideas to create it?

 

Just as long as you are not stupid about it and make it IDENTICAL to theirs than you are fine.

 

But just be wary that if your code does look similar that it is obviously the code was copied you could get held accountable, but chances are if you are re-creating the code you will do it your own style and it will not be similar.

 

I've done this a few times, take code and make it my own. Where it gets to the point it is vs time and paying for the commercial license is what you need to figure out. If the license is $100, I would just buy the license, not worth my time to re-code it.
